Reuters vs Ross Intelligence court decision sets stage for AI and its lack of being able to claim Fair Use as a defense.

In a summary judgement (which will sure to be appealed) a decision was made in favor of Thomson Reuters in the case against the AI company Ross Intelligence. Ross Intelligence used copyrighted content from Reuters’s Westlaw search engine in building its AI. To note, Ross Intelligence was not a generative AI so the questions related to how those datasets will be reviewed in relation to Fair Use do not have any initial decisions yet, however, this is a first step in establishing that content used to create AI responses, that are based off of copyrighted material, taken without permission from the copyright holder are NOT considered Fair Use.
