Should ISPs Be Liable For Piracy?

Should ISPs be liable for the online piracy their customers commit? What if it is against their TOS and they've repeatedly been told?

The US Supreme Court has opened up a forum for input on whether ISPs (Internet Service Providers) should be liable for not curtailing IP addresses that have repeatedly been identified as participating in online piracy.

This comes about because of Sony Music Entertainment v. Cox Communications, a case that focuses on music copyright infringement at a mass level. Sony repeatedly identified IP addresses of repeated online piracy and even though it clearly breaks the terms of service of any ISP, Cox has done what every ISP does, which is nothing.

So, should ISPs be responsible for holding up their Terms, or similar to YouTube, should they just ignore the abuse because it maximizes their profit? Oh wait, whoops, did I just call out the greed of corporations as their guiding force? Yup. Nothing new.

PS Today’s AI generated featured image “liable ISPs” is brought to you by “clearly stealing IP from Superman”, “Are those glasses or masks on their … faces?”, and “don’t look too closely or that elbow will look super out of place”.
